CONCERNING
TWELFTH AMENDMENT TO DECREE OF THE MINISTER OF FINANCE No. 89/KMK.04/2002 CONCERNING PROCEDURE FOR THE EXEMPTION FROM IMPORT DUTY AND AND EXCISE ON IMPORTED GOODS FOR THE NEED OF INTERNATIONAL AGENCIES AND THEIR OFFICIALS ASSIGNED IN INDONESIA
THE MINISTER OF FINANCE,
Considering:
- a. that based on the result of examination conducted by the Directorate General of Customs and Excise on the application file on International Organization for Migration (lOM) and in consideration of the recommendation of the State Secretariat under Letter No. B-11399/Setneg/Setmen/KTLN/05/2008 dated May 28, 2008, IOM is decided as international organization that has obtained import facilities based on the provision in customs matter;
- b. that based on the result of examination conducted by the Directorate General of Customs and Excise on the application file on Economic Research Institute for ASEAN and East-Asia (ERIA) and in consideration of the recomendation of the of State Secretariat under letter No. B-10929/Setneg/Setmen/KTLN/ 05/2008 dated May 22, 2008, ERIA is decided as international organization that has obtained import duty facilities based on the provision on customs matter;
- c. that based on the consideration as intended in a and b above, it is necessary to stipulate Regulation of the Minister of Finance on the Twelfth Amendment to Decision of the Minister of Finance No. 89/KMK.04/2002 concerning Procedure for Exemption of Import Duty and Excise for Imported Goods for the use of International Agencies and their Officials assigned in Indonesia;
In view of:
- 1. Law No. 10/1995 concerning Customs (Statute Book No. 75/1995, Supplement to Statute Book No. 3612) as amended by Law No. 17/2006 (Statute Book No. 93/2006, Supplement to Statute Book No. 4661);
- 2. Law No. 11/1995 concerning Excise (Statute Book No. 76/1995, Supplement to Statute Book No. 3613) as amended by Law No. 39/2007 (Statute Book No. 105/2007, Supplement to Statute Book No. 4755);
- 3. Presidential Decree No. 20/P/2005;
- 4. Decree of the Minister of Finance No. 89/KMK.04/2002 concerning Procedure for the Exemption on Import Duty and Excise on Imported Goods for the Need of International Agencies and Their Officials assigned in Indonesia as amended several times, the latest by Regulation of the Minister of Finance No. 82/PMK.04/2006;
HAS DECIDED:

THE REGULATION OF THE MINISTER OF FINANCE CONCERNING THE TWELFTH AMENDMENT TO DECISION OF THE MINISTER OF FINANCE No. 89/KMK.04/2002 CONCERNING PROCEDURE FOR THE EXEMPTION FROM IMPORT DUTY AND EXCISE ON IMPORTED GOODS FOR THE NEED OF INTERNATIONAL AGENCIES AND THEIR OFFICIALS ASSIGNED IN INDONESIA.
Article I
Amend Attachment I Paragraph V of Decision of the Minister of Finance No. 89/KMK.04/2002 by adding 2 (two) numbers, namely Numbers 50 and 51, so that the entire Paragraph V shall read as follows:

Article II
This Ministerial Regulation shall come into effect on the date of Stipulation.
